These terms set out how SiteSmart provides its services to you. By ordering a website or subscribing to our Website Management plan, you agree to these terms. Please read them carefully and keep a copy.
1. About us
SiteSmart (“we”, “us”, “our”) is a sole trader business operated by Stuart Boyle, providing website design and managed website services. “You” means the customer who orders our services. You can reach us through our contact page.
2. Our services
We offer two main services:
- Website builds — designing and building a website for your business, quoted from £299, depending on size and requirements.
- Website Management — an ongoing monthly plan at £15.99/month that includes hosting, software updates, daily backups, security checks, uptime monitoring, friendly support, small content changes, and registration and management of a standard domain name.
The exact scope of your build or plan will be confirmed with you before we start.
3. Quotes and orders
Quotes for website builds are valid for 30 days unless we say otherwise. A contract is formed when you accept our quote or subscribe to a plan, and we confirm it. We may decline or cancel an order before work begins if we are unable to provide the service.
4. Fees and payment
For website builds, we usually take a 50% deposit before starting, with the balance due once the site is ready to go live. The site goes live once payment is complete.
Website Management is billed monthly in advance at £49/month through our payment provider, Stripe, starting from the date you subscribe. Where a build includes a first month of management, that month is included at no extra charge.
We may change our prices from time to time. For ongoing plans, we will give you at least 30 days’ notice of any price change before it takes effect.
5. Subscription term and cancellation
The Website Management plan runs on a rolling monthly basis with no minimum term — you can cancel at any time. To cancel, let us know or use your billing portal. Cancellation takes effect at the end of your current paid month, and we will not charge you again after that. We do not provide refunds for the current month once it has started, but you keep the service until the end of that month.
When your plan ends, hosting and management stop. We will help you move your website and domain to another provider, and we can provide an export of your site on request.
6. Your right to cancel (consumers)
If you are a consumer (an individual buying outside your trade or business), you have the right to cancel within 14 days of entering into the contract, under the Consumer Contracts Regulations 2013. If you ask us to begin work within that period, you may need to pay for work already done if you then cancel. This does not affect the rolling cancellation right above.
7. Domain names
Where domain registration is included with your plan, the domain is registered in your name — you are the legal owner. We act as the administrative and technical contact and manage it on your behalf while you are subscribed. “Included” covers standard domains such as .co.uk and .com; premium or specialist extensions may carry an additional charge, which we will agree with you first. If your plan ends, the domain remains yours, and we will help transfer its management to you or your chosen provider.
8. Your responsibilities
To help us provide the service, you agree to:
- provide the content, images and information we need in good time;
- ensure any material you give us is lawful and that you have the right to use it;
- keep your payment details current; and
- Use the service lawfully and not for any harmful or illegal purposes.
9. What is included
“Small content changes” means minor edits such as updating text, swapping an image or changing contact details, within reason. Larger work — such as new pages, redesigns or new features — is quoted separately. We will always let you know before treating something as additional work.
10. Intellectual property
Once your build is paid for in full, you own the finished website and its content. We retain ownership of any underlying tools, code libraries or templates we reuse across projects, and any third-party or licensed assets remain subject to their own licences.
11. Hosting and availability
We use reasonable endeavours to keep hosted websites available and to take regular backups, but we cannot guarantee uninterrupted, error-free service, as some factors are outside our control. We are not responsible for issues caused by third-party services, your own changes, or events beyond our reasonable control.
12. Suspension for non-payment
If a payment fails and is not resolved after reasonable reminders, we may suspend hosting and management until your account is brought up to date. We will always try to contact you first.
13. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited by law. Subject to that, our total liability to you is limited to the fees you have paid us in the 12 months before the issue arose, and we are not liable for indirect or consequential losses, loss of profit, or loss of business.
14. Ending the agreement
Either of us may end the agreement by giving reasonable notice. We may end it immediately if you seriously breach these terms or fail to pay. Upon termination, any outstanding fees become due, and the provisions regarding domains, data, and liability continue to apply.
15. Data protection
We handle personal data in line with our Privacy Policy. Where we process personal data on your behalf as part of managing your website, we do so only on your instructions and will enter into a data processing agreement if you need one.
16. Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Changes to these terms
We may update these terms from time to time. The current version will always be on this page. For ongoing plans, we will give you reasonable notice of any significant change.
